SCHULZ MOTOR AUCTIONS TERMS & CONDITIONS

  • Bids will only be accepted from LICENCED MOTOR DEALERS or their AUTHORISED AGENTS.
  • All agents must be authorised by their Dealer Principal in writing and identified by Schulz Motor Auctions prior to the auction commencing.
  • If beyond your control the highest bidder is not a Licenced Motor Dealer/s the lot will be put back and resold.
  • The highest bidder shall be the purchaser if accepted by the auctioneer.
  • Any bid acknowledged by the Auctioneer shall not be withdrawn.
  • Schulz Motor Auctions reserves the right to accept or reject a bid at their discretion.
  • In a case where a dispute over two or more bids that the Auctioneer cannot decide who was the last and highest bidder, the lot will then be put up again and resold.
  • The Auctioneer has the right to open the bidding.
  • Written faxed pre auction bids will be accepted by the Auctioneer if lodged no later than 9am on auction day. The Auctioneer will announce prior to each lot if any pre auction bids have been received. Successful pre auction bid will bind the bidder as purchaser to all these conditions.
  • All lots having been available for inspection are deemed that the goods have been inspected by the purchaser. All lots are sold in their current state of repair and condition at the time of auction with all defects and faults (if any).
  • All lots are the buyer’s responsibility from the fall of the hammer.
  • Schulz Motor Auctions reserves the right to refuse any person or person’s admission to the auction site.
  • Schulz Motor Auctions reserves the right to withdraw any lot from sale at any time without assigning any reason.
  • Schulz Motor Auctions does not guarantee year models or odometers although every effort is made to ensure they are correct.
  • All lots must be removed by noon the following day.
  • No lot will be delivered during the sale.
  • No lot is to be removed from the premises before all relevant paperwork is properly signed and authorised.
  • Transport is the responsibility of the purchaser (including returns).
  • Although all care is taken Schulz Motor Auctions accepts no claims for damages made to vehicles left in our possession.
  • No vehicles are to be moved or started while the auction is in progress.
  • Only people authorised by Schulz Motor Auctions are to drive vehicles on the auction premises.
  • Vehicles sold from Schulz Motor Auctions premises are not subject to the cooling off period.
  • Vehicles sold from Schulz Motor Actions premises DO NOT HAVE A STATUTORY WARRANTY.
  • Schulz Motor Auctions reserves the right to cancel accounts if payments are late or cheques dishonoured.
  • Schulz Motor Auctions reserves the right to demand the whole payments of the lot or lots in cash or bank cheque if deemed necessary.
  • All cheques for consignment vehicles must be separate and made out to Schulz Group Trust Account.
  • The goods shall remain the sole & absolute property of the vendor as legal and equitable owner and the customer shall hold the same as bailee until such time as the customer shall have satisfied all of his obligation by way or cleared funds. Title in the goods shall only pass to the customer when the vendor receives complete satisfaction.
